Nevada court keeps Roethlisberger trial in Reno

After two consecutive offseasons that resulted in women accusing Ben Roethlisberger of sexual assault, the Steelers franchise quarterback served a four-game suspension to start the 2010 season for violating the league's personal conduct policy, and spent the ensuing months trying to salvage his image.

While the Steelers' offseason wasn't particularly quiet, we didn't hear a peep from Big Ben until late July … when he married Ashley Harlan.

Roethlisberger appears to have matured in recent months, but that doesn't mean his past may not catch up to him. The Nevada Supreme Court decided Thursday that a civil suit accusing Roethlisberger of sexual assault can be tried in the county where it was originally filed.

PFT head honcho and attorney Mike Florio explains:

"It means that the case will finally proceed, and that it will do so in the county in which the plaintiff’s lawyer chose to file the case. Fights over forum selection are common in civil suits. The lawyer representing the plaintiff, when faced with a choice of possible venues, picks the one that the lawyer believes will be the kindest to the plaintiff. If the lawyer for the defendant(s) believes that another possible forum exists that would be less favorable to the plaintiff, the lawyer for the defendant(s) sometimes tries to move the case there."

The lawsuit stems from an August 2009 incident when a 33-year-old woman working at Harrah's Lake Tahoe while Roethlisberger was staying there during a celebrity golf tournament, accused the Steelers QB of sexually assaulting her.

"We're delighted with the court's ruling and look forward to proceeding with the case in 2nd Judicial District Court," the woman's lawyer, Cal Dunlap, told the Associated Press when contacted by telephone.

David Cornwell, one of Roethlisberger's attorneys, said the Supreme Court ruling "does not affect the likely outcome of this case." And in an emailed statement to the AP, Cornwell said after considering the woman's own words, "the jury will conclude that Ben has been falsely accused."

Either way, as Florio points out, it might be in Roethlisberger's best interests to settle the case before it gets to court if for no other reason than to put the incident behind him and get on with his life.

Let me dumb it down for you RedWing moron.

Yes, civil suits are MUCH easier to win than a criminal case.  The reason these get filed against rich and famous people, STUPID, is to try to get a settlement.  You obviously aren't smart enough to realise the State Prosecutor determined this was a sham case.  You do understand genius that she did call police???

Did Ben have sex with this dirty skank????  I have no clue.  If he did my hat is off to him.  From the looks of her there isn't enough booze in the world to throw her one.  But you don't need to rape anything this ugly.  Now, I understand you are a Lions' fan(pathetic)who have never won anything.  Are you jealous of Ben and the Steelers, or did you take offense since this skeezer is more attractive then what you have?  Because even the most ardent Steeler hater KNOWS this slut went willingly if they had sex.

Ben may be a mental midget and I wish the Steelers would have sacked him to the curb.  I have no clue what happened in that bathroom stall in Georgia, but he did not rape this worthless scumbag.  You keep up the good fight though RedWing!!!

First off, nobody rapes any girl that ugly.  Second, the State Attorney decided not to press charges, especially when he got a gander at this skank.  This is a civil suit, she better hope the jury is both blind and dumb if she wants to win this.

I know what I'm about to say is way over your head and you'll probably need to read it 10 times just to understand half of it, but I'll give it a shot.  There is a reason why people file a civil suit and at times don't even want to try and beat somebody in criminal court.  To convict somebody in criminal court you have to prove the person is guilty "beyond a reasonable doubt".  That's very tough to do when you're going against a famous person that can afford to hire the best legal team that'll take his case in the country that also has unlimited resources.

BUT... In civil court there is no "beyond a reasonable doubt".  To dumb it down for stupid people like you I'll just say as long as most of the evidence or a good portion of the evidence is against the accused, the accuser can take a wealthy guy like Ben down. And considering most famous athletes like Ben have plenty of assets and a ridiculous income the defendant can't hide, they have to pay if they lose.  So knowing all of that in most cases a guy like Ben that is very likely guilty as hell settles out of court.  When he does we'll read statements from his lawyers telling the world he's not admitting guilt or any wrong doing at all, but only settling out of court so he can focus on football and spare his new wife and his family the embarassment and bad press.

And then 90 percent of Pittsburgh fans and Ben groupies on these board will enlighten us with some incredible posts, just like yours.  They'll all tell us famous innocent people do this all the time. It's easier, the money means nothing to them and bla bla bla.

Even as a Big Ben hater I'll put myself out there and say this much.  If Ben fights this in court to the end and wins his case, I'll respect him a lot more then I ever did. I still won't like him because he's a pompous ass and c'mon, even a lot of his teammates don't like him so why would I? But I'll gain SOME respect for him because he didn't bail or take the easy way out.   But if he loses in court or worse yet in some ways settles out of court?  I'll hate the guy even more and know 10000 percent in my mind the guy sexually assaulted this girl. And nothing any one of you buffoons is going to say will change my mind.
